Terms of Service

These Terms govern your use of Elementex (“the game”), operated by Tassilo Posegga, an individual developer based in Germany (see the Impressum). By installing, launching, or playing the game you agree to these Terms. If you do not agree, do not install or play. How we handle personal data is described in the Privacy Policy.

1. Eligibility

You must be at least 13 years old to play. If you are between 13 and the age of majority where you live, you may only play with the consent of a parent or legal guardian. If we learn a player is under 13, we will terminate the account and delete associated personal data.

2. Your account

• Anonymous play. On first launch the game creates an anonymous account stored on your device and our backend. No sign-up is required.
• Optional linking. You may link Google Play Games (Android) or Sign in with Apple (iOS) so your progress survives a phone swap.
• One account per person. Do not create multiple accounts to manipulate the leaderboard or the gem economy, and do not share or transfer your account.
• You are responsible for activity on your account, including purchases made on your device.

3. Acceptable use

You agree not to:

• Cheat, exploit bugs, or use automation, scripts, modified clients, or memory editors to alter gameplay, scores, gem balance, or inventory.
• Reverse-engineer or extract source code or assets beyond what the law permits.
• Use any name or leaderboard display field to publish unlawful, infringing, or harassing content.
• Probe or attempt to breach the security of the game or its backend.
• Sell, trade, or transfer in-game items (runes, gems) for real-world value.

We may invalidate scores, reset inventories, or suspend accounts that break these rules; serious or repeated breaches may lead to permanent termination (§6).

4. Virtual currency (gems)

• No real-world value. Gems exist only inside the game; they are a limited, revocable, personal licence to use a feature — not money or property.
• Non-transferable. Gems cannot be sold, traded, gifted, or redeemed for cash outside the game.
• No paid randomness. Elementex has no loot boxes or gacha. Every gem spend has a visible, fixed outcome shown before you confirm.
• Refunds. Purchases are final once gems are credited, except where the law requires a refund (e.g. EU withdrawal rights for digital content, or Google/Apple store policy). Store refund requests are handled by Google or Apple directly.
• Termination & service end. If your account is terminated for breach, unspent gems are forfeited. If the game is discontinued, we will give at least 30 days’ notice and, where required by law, allow redemption or refund of unspent purchased gems during that window.

5. Purchases

Purchases are processed by Google Play Billing (Android) or the App Store (iOS); we never receive your payment-card details. The price shown at checkout is the price you pay, and may vary by region. The store’s refund policy governs accidental or under-age purchases, and we will support reasonable requests routed through the store.

6. Termination

• By you. Stop playing any time, and request account deletion via in-game Settings or by emailing tassilo@posegga.eu.
• By us. We may suspend or terminate accounts for breach of these Terms, fraud, or chargeback abuse. Where a breach is curable we will normally warn you first.

7. Intellectual property

The game, its code, art, music, names, and brand are owned by the operator or its licensors. These Terms grant you a personal, non-exclusive, non-transferable, revocable licence to install and play for non-commercial entertainment. You may share screenshots and short clips for personal, non-commercial purposes; other commercial use needs written permission.

8. Disclaimer & liability

The game is provided “as is” and “as available”, without warranties to the maximum extent permitted by law. We do not warrant that it will be uninterrupted or error-free, or that online features (leaderboard, economy) will always be available.

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability for intent, gross negligence, injury to life, body, or health, or any liability that cannot lawfully be excluded — including mandatory statutory consumer rights, which remain unaffected.

9. Governing law

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also enjoy the mandatory protections of the law of your country of residence, and may bring proceedings there. If any provision is unenforceable, the rest remain in effect.

10. Changes

We may update these Terms. The “Last updated” date above shows the most recent change; material changes will be surfaced via an in-app notice on the next launch. Continued play after a change constitutes acceptance.
